Is there some way to keep a ticket off my driving record?

Answer: The City Attorney has a Diversion Program for certain traffic offenses, including speeding. Contact the Court Services Officer at 238-3103 ext 273.


What can happen if I miss a court date?

Answer: The Judge will issue a warrant for your arrest.


What can happen if I don't make the payments the Judge ordered?

Answer: The Judge can revoke your probation or parole and place you in jail if he finds that your failure to pay is deliberate and that you had the ability to pay but did not do so.


Who do I have to pay Court Costs if I don't contest the case?

Answer: Court costs are assessed in every case regardless of whether the person pleads guilty or contents the case. This is the City Commission's policy.


Does the City have a Diversion Program for cases other than traffic?

Answer: There are diversion programs for first time DUI offenders, first time domestic violence offenders and some traffic offenses. Diversion is a procedure where the defendant steps out of the prosecution process and is placed on informal probation. They are required to pay fees and undergo specified treatment/intervention. Upon successful completion of the terms of diversion, the underlying offense is dismissed.


Do I have a right to a lawyer in the Municipal Court?

Answer: A lawyer can represent everyone if they choose. If a person is found to be indigent according to guidelines and is facing a possible jail sentence, the Court will appoint a lawyer for them.


Why don't the Police give warning tickets the first time they see someone commit a traffic offense?

Answer: Each Officer is empowered to determine whether to give a warning or a "hard ticket". They exercise this discretion on a case-by-case basis. It should be remembered that the Officers are empowered to write a "hard ticket" each time they observe a violation of the traffic ordinances.
