Does the City have a Diversion Program for cases other than

Answer:
There are diversion programs for first time DUI offenders, first
time domestic violence offenders and some traffic offenses. Diversion
is a procedure where the defendant steps out of the prosecution
process and is placed on informal probation. They are required to
pay fees and undergo specified treatment/intervention. Upon successful
completion of the terms of diversion, the underlying offense is
dismissed.
Do I have a right to a lawyer in the Municipal Court?
Answer:
A lawyer can represent everyone if they choose. If a person is found
to be indigent according to guidelines and is facing a possible
jail sentence, the Court will appoint a lawyer for them.
Why don't the Police give warning tickets the first time
they see someone commit a traffic offense?
Answer:
Each Officer is empowered to determine whether to give a warning
or a "hard ticket". They exercise this discretion on a
case-by-case basis. It should be remembered that the Officers are
empowered to write a "hard ticket" each time they observe
a violation of the traffic ordinances.
